CONSTRUCTION DUST FROM UNIT BELOW HAS CREATED MEDICAL ISSUES FOR TENANT HE SAYS THAT HE HAS BEEN FORCED TO MOVE OUT, WANTS TO KNOW IF NOT PAYING RENT CAN BE JUSTIFIED IN THIS SITUATION? LEASE IS STILL ACTIVE.

Dust from construction in the commercial space below my apartment (Starting April 11) has forced me to move out of my apartment (on May 9th) due to throat and lung issues. My landlord is charging me for rent despite the problem never being resolved. I am forced to move out of the building to protect my healthreference: 007002-26CP

Per CSB: Follow up to incident report 25-00269253 my landlord says this has been fixed. A minimal attempt has been made to restore access to my door, but it leaves me with raw... Asphalt? Tar? Being tracked into the studio. And the sidewalk is still barricaded with a big pile of crap. This has been a month now
