The land use permit says the townhomes are going to be 3 stories but they are clearly 4 stories and in my opinion a violation of the code. Under any circumstance I can imagine in addition to the 4 story structures being build they would be allowed to have a rooftop deck with an additional door and structure above the 4th story for access to the rooftop.
