Due to a leak, weneed to have the tenant move out. The owner has offered to let the tenant break the lease without penalty, and have the last months rent and deposit refunded. The tenant is not willing to move unless they receive 3 months rent as compensation. We can't move forward with the repairs until the tenant is out. What are our rights?

Complainant says another unit leaked (1/2024) which caused water damage in his unit. Repairs need to be done which would require tenant to move. Only option is to move without further penalties. Been living with damage for months. Been paying full rent, this is not right. On a 12month lease ends 9/2024. Was told by Mgmt tenant needs to vacate the unit by their timelines once damage is accessed. They are coming to access on April 9th
