Tenant had an agreement for landlord to withdraw from tenant account for monthly rent. Lease is ending and owner took full amount instead of portion and won't give it back. Landlord acknowledged they charged too much and still won't return the over payment. What are rights?

Jackhammers being used at the intersection of 6th Ave. and Denny as I type this (nearly 10 p.m.), well past the weekday hour cut-off of 5 p.m. Absolutely ridiculous. Like people don't have jobs or lives. Insane to do this kind of work where several dozen multi-family housing buildings are located. And illegal.
